LIMITED WARRANTY

Seller warrants that the Goods delivered under Buyer’s Order will be free from defects in material and workmanship for a period of twelve (12) months from the date of original shipment.  

The specific warranty for a given product is the one in effect on the date of shipment. In the event that Buyer identifies any defects in material or workmanship, Buyer will promptly notify Seller of the defective Goods and the specific nature of the defect in accordance with Teledyne Terms and Conditions of Sale Article 16, Return Authorizations.

Seller, at its sole discretion, will either repair or replace any such Goods found by Seller to be defective. Seller's warranty does not apply to i) any Goods that have been subjected to improper installation, usage exceeding Seller’s published specifications, alteration, repair, neglect, accident, inundation, fire, or the like; and ii) only applies to the Goods delivered by Seller under Buyer’s Order.  

THESE EXPRESS WARRANTIES, INCLUDING REMEDIES, ARE EXCLUSIVE AND ARE IN LIEU OF ANY AND ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, AND IN NO EVENT WILL SELLER BE RESPONSIBLE FOR REPLACEMENT, REPROCUREMENT OR OTHER COSTS OF A CONSEQUENTIAL OR INDIRECT NATURE TO ANY HIGHER LEVEL ASSEMBLY, DUE TO ANY DEFECT IN MATERIAL OR WORKMANSHIP. THE FOREGOING EXCLUSION INCLUDES, BUT IS NOT LIMITED TO COSTS RELATED TO SATELLITE RETRIEVAL, DIS-ASSEMBLY, RE-ASSEMBLY, LAUNCH DELAYS OR RE-SCHEDULES, LAUNCH PREPARATION CHARGES, LIQUIDATED DAMAGES FROM ANY PARTY, OR ANY DAMAGE CAUSED BY ANY ENVIRONMENTAL FACTORS. NO WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE IS INTENDED OR GIVEN.
